A Harrison woman is suing a cosmetic surgeon for $172,250 for allegedly refusing to pay a refund for a cancelled procedure.
Caroline Freebern accused Dr. Steven T. Greenberg and Greenberg Cosmetic Surgery and Dermatology of fraud, in a complaint filed on June 13 in Westchester Supreme Court.
She has suffered “severe mental distress, depression, anxiety and humiliation,” the complaint states, as a result of their alleged misconduct.
Dr. Greenberg is “New York’s celebrity cosmetic surgeon,” according to Greenberg Cosmetic Surgery’s website, and the medical practice is rated No. 1 in facial treatments in New York. The practice is based in Woodbury, Nassau County, and has an office in Scarsdale.
Freebern agreed in June 2023 to pay $62,250 for a cosmetic procedure, according to the complaint. The medical practice promised to help her get a bank credit plan to pay for it but then forced her to pay the entire amount directly.
The procedure was scheduled for July 13, 2023. But it did not take place, the complaint states, and Greenberg Cosmetic Surgery refused to make a refund.
The complaint does not say what procedure Freebern paid for, why it did not take place or who decided to cancel it.
Freebern claims that the doctor and medical practice improperly reaped significant benefits; engaged in malicious conduct that breached the duty of good faith and fair dealing; engaged in fraudulent conduct; and inflicted emotional distress.
She is demanding $10,000 in legal fees, a $62,250 refund, and $100,000 in punitive damages.
The doctor and the medical practice did not reply to a message, submitted through Greenberg Cosmetic Surgery’s website, asking for their side of the story.
