A Florida firm claims that a small Monsey pharmacy has failed to pay nearly $3 million for Covid-19 home test kits delivered last year.
Crest Diagnostics of Aventura, Florida, accused Greenbaum’s Pharmacy Inc. of breach of contract, in a complaint filed June 15 in U.S. District Court, White Plains.
Greenbaum’s, established in 1983 by Hershel Greenbaum, is located in a small plaza on Monsey’s Main Street. Online reviews tout its services as exceptional and “much better … than you would get at a Walgreen’s or CVS.”
Crest describes itself as a national distributor of diagnostic testing supplies. The firm was organized last October, according to a Florida Division of Corporations record, barely three weeks before it began doing business with Greenbaum’s.
On Oct. 28, Greenbaum’s agreed to buy diagnostic testing products, the complaint states, and from October to December placed orders for 56,416 Covid-19 home test kits.
Greenbaum’s agreed to pay for the kits within 30 days of delivery, according to the product supply and fulfillment agreement.
The deal was signed by Crest CEO Justin Covillon and Greenbaum’s pharmacy manager Leah Askarinam.
Crest claims the kits were delivered, the pharmacy was invoiced weekly, and the bill came to nearly $4.3 million.
Greenbaum’s made 13 payments totaling $1.3 million, the complaint states, leaving $2,959,408 as unpaid and interest accruing at 18% per month.
Greenbaum’s did not reply to an email asking for its side of the story.
