The town of Fairfield has filed a breach-of-contract lawsuit against Julian Development seeking up to $3 million in payment over a fill pile.
The lawsuit, filed in state Superior Court in Bridgeport, maintains that the pile of construction waste at One Rod Highway grew by three times from 2013 to 2016 despite the contract”™s proviso that it be reduced. The fill pile is also contaminated with low levels of PCBs and lead, the lawsuit alleges.
The town is seeking to attach receivables and assets of Julian Development, a division of Milford-based construction and development company Julian Enterprises, to help pay for removal of the pile by a third party.
