A state judge upheld New York”™s much-debated SAFE Act gun control law Wednesday, saying it did not violate the federal or state constitutions.
Gov. Andrew Cuomo pushed the state Legislature to speedily vote on the bill in January 2013, amid scrutiny and pushback from gun-rights groups who said it infringed on federal Second Amendment rights. State Supreme Court Judge Thomas McNamara said the law was valid based on the governor”™s “message of necessity,” which allows a vote on a proposed bill without a three-day wait period as is necessary otherwise.
Robert Schulz, who filed the suit, will appeal the ruling, according to Newsday.
State Attorney General Eric T. Schneiderman, a Democrat, praised the judge”™s decision. “New Yorkers deserve to live in a state with a strong set of procedures in place to protect them from gun violence,” he said. “We will continue to defend and expand our state”™s efforts to ensure the safety of all New Yorkers by keeping guns out of dangerous hands.”
