Norwalk agency Betty Advertising has filed a lawsuit against PepsiCo Inc. over a TV commercial that aired during the Super Bowl, claiming that the soda giant stole its design ideas. Filed in Manhattan federal court, Betty claims the Purchase, N.Y.-based PepsiCo listened to a pitch of its “All Kinds/Living Jukebox” concept in November but rejected the idea.
The suit, which seeks unspecified damages, maintains that Pepsi then produced its own ad that aired during the Super Bowl halftime show in February, featuring a “human jukebox” in which a character goes from room to room with the style of music changing in each one.
PepsiCo said it plans to “vigorously defend” itself against the suit, claiming it is meritless.
