A Westchester County man who dealt in eyewear was seeing red when he sent his business partners an email that earned him 12 months in federal prison.
Roger Eichenholtz, of Yorktown Heights, was sentenced Friday to 12 months in prison for making threats over the Internet. He pleaded guilty April 28 to sending threatening communications through interstate commerce.
Eichenholtz lost an intellectual property lawsuit over his eyewear business in 2013. After the civil litigation, in which he represented himself, Eichenholtz repeatedly harassed his opponents via email, according to an FBI press release. On Sept. 24, 2013, Eichenholtz sent another email threatening civil and criminal litigation. He concluded the email by saying “PLAN B ”“ if for some unforeseen miracle, you escape justice, I have access to a ”˜Side Bolt 45.cal (sic) with six silver bullets that have your name on them.”™”
In addition to the prison term, U.S. District Court Judge Paul S. Diamond ordered three years of supervised release, a $100 special assessment and that the defendant be taken into immediate custody.
