A former North Castle attorney was sentenced in Westchester County Court in White Plains April 23, to three to nine years in state prison for stealing $1.53 million while transacting real estate business.
In January, Kevin Hymes, now 40, pleaded guilty to two counts of second-degree grand larceny, two counts of third-degree larceny and one count of scheming to defraud. All are felonies.
Hymes, who practiced law in White Plains, was also ordered to repay $1.53 million to wronged parties. Prosecutors had alleged, among other crimes, that he stole security deposits for home purchases and swindled banks on closing costs.
“Over a five-and-one-half year period, between Jan. 1, 2007 and June 27, 2012, the defendant, who was a real estate attorney with an office in White Plains, defrauded several individuals and entities by making false representations in connection with real estate closings,” according to a statement from District Attorney Janet DiFiore”™s office.
On April 3, Hymes was convicted in federal court of participating in a $58 million mortgage fraud scheme. The sentence for that crime will run concurrently with his state sentence. He has been disbarred, as well.
Assistant District Attorney Shara Abraham of the Public Integrity Bureau prosecuted the case.
