Court bars Stew Leonard’s in Orange

Overturning a lower trial court”™s ruling, the Connecticut Supreme Court barred Stew Leonard”™s Inc. from building a supermarket on property the company owns in Orange that includes marshlands.

In a majority decision, Justice William Sullivan wrote that the Orange wetlands commission did not properly establish the store would comply with governing wetlands law and regulations. In a concurring decision, Justice Flemming Norcott Jr. wrote that Stew Leonard”™s application lacked an effective erosion-control plan.

In addition to its flagship location in Norwalk, Stew Leonard”™s owns supermarkets in Danbury, Newington and Yonkers, N.Y.
