In a majority decision, Justice William Sullivan wrote that the Orange wetlands commission did not properly establish the store would comply with governing wetlands law and regulations. In a concurring decision, Justice Flemming Norcott Jr. wrote that Stew Leonard”™s application lacked an effective erosion-control plan.
