Hearing scheduled in Xerox lawsuit against Christian publisher

A lawsuit filed by Xerox Corp. against a Christian book and music publishing company that defaulted on digital equipment leases will be heard tomorrow in district court in Oklahoma.

According to a report in The Oklahoman, Xerox is seeking $2 million plus interest from Tate Publishing & Enterprises LLC of Mustang, Oklahoma. Tate Publishing had leased Xerox digital presses and related printing equipment in 2011 and 2013, but defaulted on its lease payments and wound up owing $593,308 by late 2015. The companies agreed to an account modification agreement that included a $100,000 credit to Tate Publishing, but in February 2016 Xerox charged the publisher with defaulting again. Xerox repossessed its equipment last July.

Tate Publishing acknowledged defaulting on its payments, but stated that the equipment was defective and that Norwalk-based company misrepresented its abilities to meet Tate Publishing”™s output.
