Eastchester lawyer disbarred for misappropriating funds

An Eastchester real estate attorney has been disbarred for misappropriating nearly $740,000 in real estate deals.

A panel of judges from the state court’s Second Appellate Division ordered Alfred Anthony Delicata Jr. on July 10 to stop practicing law.

Delicata had submitted a resignation to the appellate court last November, acknowledging that he was under investigation by the attorney disciplinary and grievance committee for Westchester County.

The investigation concerned two checks from his attorney escrow account that his bank declined to honor, according to the appellate court, and allegations that he had misappropriated $739,926 in 23 real estate matters from January 2020 to March 2021.

Delicata conceded “that he cannot successfully defend against the allegations,” according to the appellate court, “based on the facts and circumstances of his professional conduct.”

Delicata claimed, and the grievance committee verified, that he paid back everyone involved in the real estate matters.

The appellate court order does not describe any specific incidents. But last year, according to Westchester Supreme Court records, Delicata was accused of preparing a fraudulent deed for a client. His client and the plaintiff settled the dispute last September.
